Conditions of participation

I. Participation

Status: 01.04.2021

Use of the Radbonus app is free of charge for users. Anyone worldwide may download the Radbonus app (as long as the Radbonus app is available in the app store of the country is available). The installed Radbonus app can record cycling kilometers worldwide. The Radbonus T&Cs must be accepted, otherwise the app can record cycling kilometers, but no actions will be actions will be activated. Participation in all campaigns organized by Radbonus is only possible via the Radbonus app. Cycle kilometers can be synchronized with other apps and operating operating systems can be synchronized. These synchronized cycle kilometers also count towards the campaigns.

The actions are divided into open and exclusive:

• The open campaigns are open to any user who has installed the app has installed the app and lives in Germany can take part. The bonuses are sent exclusively to Germany. Eligible to participate in the open offer are all natural persons aged 12 and over.
• An access code is required to participate in the exclusive promotions. This is entered under the access code in the app. Thereupon the corresponding exclusive promotions with bonuses are activated. In the case of an exclusive promotion (whether by the employer, the health insurance health insurance company, the city or third parties), separate partner terms and conditions may apply. The user must accept these in order to participate in the participate in the exclusive offer. The partner T&Cs extend or overwrite the Radbonus T&Cs.

Possible restrictions for journeys that are to be counted:

• Geo-area:… have the starting point or end point in a defined geo-area. For example, this is interesting for employers who only want to reward the journey to work. Or cities that only want to incentivize journeys in their own city. The geo-data is only analyzed locally on the cell phone and saved again immediately. The partner does not receive any geo-data from the cyclists here either.
• Time:… took place at a defined time. For example, this option is interesting for employers who only want to reward the journey to work. Night-time journeys are then excluded.
• Weekdays:… have been recorded on a defined day of the week. For example, this is interesting for employers with normal working hours during the week who only want to reward the journey to work. In this case, journeys at the weekend are not counted.

Bonuses

Eligibility to receive the bonuses: The bonuses have a time-limited re-registration, redemption or collection period. If this period is exceeded, the user has lost their authorization to receive the bonus. Only the bonuses set by Radbonus will be awarded. The bonuses may differ in color and design from those shown.

Raffles:

• Simple: For challenges with a prize draw as the goal, all users who have completed the challenge will be entered into a prize pot. At the end of the challenge (no later than 7 days after the end of the campaign), the winners are drawn at random. The winners will be notified in the app and will receive the predetermined prize. The number of prizes is determined by the partner.
• Ticket per milestone: For challenges with a milestone prize draw, the user has the opportunity to complete the challenge several times. For each time the challenge is completed, the user receives another ticket, which ends up in the lottery pot. This increases the chance of winning.

Fixed prizes:

• Simple: For challenges with a fixed prize as the goal, all finishers receive the bonus.

• Limited fixed prizes: The partner defines a limited number of bonuses. The first finishers receive the bonus. Once the bonuses have been awarded, the challenge is ended prematurely.
• Different prizes per milestone: In the case of challenges with a fixed milestone prize, the user has the opportunity to receive increasingly better prizes by reaching the various milestones. For example: 1st milestone with 50km = 5 Euro voucher, 2nd milestone with 100km = 10 Euro voucher.

Exclusion:

Radbonus and its partners exclude all persons from the bonus payout who use unauthorized aids or otherwise gain advantages through manipulation in order to participate in the campaigns. Radbonus and its partners are entitled to exclude individual persons from participation if there are given reasons (e.g. if untrustworthy kilometers appear at the user and no clarification with the user is possible). If unreliable kilometers appear and there is a suspicion of the use of unauthorized aids, then this participant will be automatically excluded after unsuccessful contact with the person.

Information on the campaigns:

Details of the promotions can be viewed on the Radbonus website and in the app until the end of the promotion. There is no entitlement to constant availability in the app.

Declaration of consent:

By using the Radbonus app, the user accepts the use and storage of activity-related data. Only persons who accept and have read the partner’s terms and conditions of use and participation can take part in the exclusive partner promotions. This also constitutes consent to the use and storage of activity-related data. The terms and conditions of use and participation of the partners override the terms and conditions of use and participation of Radbonus.

By participating, the participant confirms that he/she has checked his/her own health requirements for participation, if necessary with the help of a doctor, and that he/she accepts the health risks arising from his/her participation. It is recommended that all participants have their fitness for sport checked by a doctor. We advise people with pre-existing medical conditions to ensure that they are fit to participate in sport before taking part.

Each participant bears the risk of personal injury or damage to property resulting from their activities during the campaign. Liability for culpable injury to life, limb or health remains unaffected. The organizer is not liable for damages caused by participants, even if they arise as a direct result of participation in the campaign. If claims for damages can be asserted, the liability of the initiators is limited to intent and gross negligence. If there is intentional or grossly negligent behavior, the liability for damages is limited to the foreseeable, typically occurring damage. The limitations of liability also apply to vicarious agents of the organizer as well as third parties used by the organizer to carry out the campaign. No liability is assumed for valuables, clothing, etc.

The activity takes place outdoors. Accordingly, the use of suitable clothing and equipment is recommended. The legal traffic regulations must of course be observed. The participant undertakes to observe and implement all regulations. To this end, Radbonus recommends that participants wear a roadworthy bicycle helmet to ensure greater safety.

The providers can discontinue the promotion at any time without giving reasons. Despite careful examination of the content, Radbonus accepts no liability for the content of external links, for the bonuses and for the implementation of our partners. In particular, the organizer reserves the right to interrupt or terminate the campaign at any time without prior notice for good cause, especially in the event of a breach of order and discipline or unsportsmanlike conduct.

Claims for damages against Radbonus or its partners arising from premature termination of the event for good cause cannot be asserted. If, in cases of force majeure (storms, etc.), the organizer is entitled or obliged for safety reasons to make changes to the implementation of the event or to cancel or cancel it, there is no entitlement to claims for damages.

Legal recourse is excluded for all points. German law applies exclusively.

II. Technical use of the Radbonus app

Access rights on the smartphone

The app calculates the kilometers driven with the help of location services and the smartphone’s motion sensors. To do this, the location services must be activated on the device and active permission must be granted to the app to use location-based data. The calculation is triggered by manually pressing the start and stop button in the Radbonus app at the beginning and end of the bike ride. No location-based data is retrieved outside of this period. The app also accesses the date and time.

Accuracy of the calculated bike kilometers

Radbonus strives for the highest possible accuracy of the rides. However, no guarantee of accuracy can be given. Depending on the smartphone and available services, the location services use a combination of mobile, Wi-Fi, Bluetooth and GPS data to determine positions. If there is no direct line of sight to a GPS satellite, a device can determine the location using the position of Wi-Fi hotspots and mobile phone masts (crowdsourcing). Radbonus cannot be held liable for technical errors. In addition, no map matching takes place in favor of privacy and battery performance. This explains smaller deviations in the km calculation compared to navigation systems.

In addition, the app contains an algorithm that uses certain parameters to filter out when a journey shows conspicuous signs of a mode of transport that is not permitted for the action. In this case, the storage of kilometers is blocked. Under certain circumstances, an unusual riding style can trigger a negative message from this algorithm. Radbonus cannot accept any liability for this. You are welcome to report incorrect deflections to Radbonus.

III. Privacy policy

Collection and processing of health, location and movement data

The app does not send any revealing data about the identity of the user to the Radbonus server. This means that no personal data is collected and stored without the user’s knowledge. When the app is installed, a Radbonus identification number (UUID as Radbonus ID) is created and stored in the app.

Only the following data is stored in connection with this number:

• Information about the measured journeys, consisting of a start time, an end time and the kilometers driven within this time with the time of data transmission to the server
• GPS-related data is used to record the track as accurately as possible, but is deleted immediately after the km has been determined.
• Access codes entered
• Selected teams
• Bonuses achieved
• Nickname
• Bike type
• Accepted terms and conditions

The data records collected are limited to the minimum required. The data is required to provide the Radbonus services (reward program for cycling). To ensure that users do not lose their recorded achievements, the data is stored on German servers until the account is deleted. Every participant can request the deletion of all their data at any time. The bike kilometers collected for a team or a mission will remain, but without the bike bonus ID. The legal basis for this is Art. 6 lit a GDPR.

The location and movement data of the participants are used by the app exclusively to calculate the mileage.

Data exchange between Google Fit/Apple Health and Radbonus

To synchronize recorded cycling km with other apps, a connection via Apple Health or Google Fit is required. This requires a separate registration with Apple Health or Google Fit. Data is only exchanged with the express consent of the user. – The following applies to the exchange between Apple Health and Radbonus: – Distances traveled are transmitted. – The means of transportation used to cover the distance is transmitted. (To check for validity) – The start and end time of the activity is transmitted (To check whether valid for challenges with “time restrictions”) – (only applies to the transfer: Radbonus ➔ Health) It is transmitted that the data was recorded with the Radbonus app:

• The following applies to the exchange between Google Fit and Radbonus: – Distances traveled are transmitted.
• The means of transportation used to cover the distance is transmitted. (To check for validity)
• The start and end time of the activity is transmitted (To check whether valid for challenges with “time restrictions”)

How Google or Apple handle the data exported to Google Fit or Apple Health is their responsibility.

Transmission of data to third parties

If a (postal) prize is to be sent, some personal data (name, address, email address and/or bike bonus ID) will be requested (which the user can refuse for each challenge). If the user wishes, this data is stored locally on the smartphone. When winning, the data is sent to a separate Radbonus server that has no link to the user’s Radbonus account. Once all winner data is available, it is sent to the respective cooperation partner and deleted by Radbonus after 6 weeks. In the case of exclusive promotions, the partners’ terms and conditions also apply.

Procedure for transmissions

Although Radbonus does not store any personal data, additional measures have been taken to secure the data during transmission from the mobile device to the server: the data is sent using SSL encryption and the IP address, which is technically necessary for the transmission of the data, is deleted from the server immediately upon receipt. This means that the data cannot be traced back to a person at any time.

Server location and jurisdiction

The AWS server used is located in Frankfurt and is designed and built to meet strict compliance standards, including ISO 27001, SOC 1, PCI DSS Level 1, to name but a few (see the AWS Compliance page for more information). AWS is fully compliant with all applicable EU data protection laws.

Reporting and information obligations in the event of data breaches

Should a data breach occur, Radbonus will report the incidents to the supervisory authority within 72 hours of becoming aware of the breach. The following information is provided: Description of the incident, specification of the category of data affected, number of data subjects and data records affected, name and contact details of the data protection officer, description of the consequences of the data breach, description of the measures taken or proposed to remedy or mitigate the breach.

Duration of data storage

Unless the participant instructs otherwise, the data will be stored until the account is deleted. In the event of a win, personal data will be collected so that the bonuses can be sent to the winners. The personal data will then be deleted within 6 weeks of being sent to the partner.

Deletion of the account

To initiate a complete deletion of all data including the Radbonus identification number, the Radbonus app must first be deleted. Then an email must be sent to support@radbonus.com with the relevant Radbonus identification number and the subject “Please delete data”. We will then send an email confirming the deletion of all data. This e-mail will also be deleted immediately after it is sent.
